This is a translation. The German version (Nutzungsbedingungen) is authoritative.
Summary
This summary makes reading easier. The full text below is binding.
- computor.at is a free learning service of TU Graz, funded by netidee.
- Your code stays yours. We use it only to provide the service.
- The workspace is for learning: no mining, no attacks, no scans, no spam, nothing illegal.
- Resources and course places are limited. Keep copies of important work via Git or by downloading it.
- We announce material changes at least 30 days in advance; changes to your detriment apply only once you agree to them.
- Austrian law; your mandatory consumer rights remain unaffected.
1. Provider and scope
1.1 The learning platform computor.at and the chat chat.computor.at (together the “platform”) are operated by Graz University of Technology, Rechbauerstraße 12, 8010 Graz, Austria (“TU Graz” or “we”), through its Institute of Theoretical Physics – Computational Physics (ITPcp), Petersgasse 16, 8010 Graz. Details are in the Imprint.
1.2 These Terms of Use govern the use of the platform by registered users (“you”). How we process your data is explained in the Privacy notice.
1.3 If you use the platform as part of a TU Graz course, TU Graz's study regulations and the requirements of that course also apply. In case of conflict, they take precedence.
2. Account and conclusion of contract
2.1 You create an account with a verified email address and password. At your first sign-in you confirm that you accept these Terms of Use. This concludes a free-of-charge usage contract for an indefinite period. You can also use the chat chat.computor.at with a separate chat account; these Terms of Use apply to it as well.
2.2 You must be at least 14 years old. Use is free of charge and creates no payment obligations for you; young people aged 14 and over can therefore agree to it themselves (§ 170(3) Austrian Civil Code, ABGB). We delete accounts of persons under 14 as soon as we become aware of them.
2.3 Each person may have only one account. Accounts are not transferable. Protect your password and email account. If you suspect that someone else is using your account, please report it immediately to security@computor.at.
3. Services
3.1 We provide free of charge: courses and exercises, a programming environment in the browser (“workspace”), automatic testing of your submissions, Git repositories for your submissions, a chat and optional Lena learning assistance.
3.2 We operate the platform with the care customary for a university learning service. Where possible, we announce maintenance on the platform in advance. We cannot promise uninterrupted availability.
3.3 Computing time, memory, storage, network access and the number and running time of workspaces are limited. Workspaces stop automatically after one hour without activity; your files are kept. Course places and the number of workspaces that can run at the same time may be limited. When capacity is exhausted, enrolling in a course or starting a workspace may temporarily not be possible. There is no entitlement to a particular course place.
3.4 We regularly back up the servers but cannot promise to restore individual files. Please keep copies of important work yourself by submitting it via Git or downloading it.
3.5 Automatic tests and points are learning aids. They are not an exam, a certificate or a confirmation of competence. If a university course uses results for an assessment, the responsible teacher decides under the applicable regulations.
3.6 Lena provides AI-generated learning help from the question and text you send and your visible assignment. It cannot execute code or grade your work. Check its answers; they can be incorrect. Requests and answers are handled temporarily as described in the Privacy notice, including bounded inference caches. Their contents are not logged or used to train models. Availability and request limits depend on capacity. Public examples also work with desktop VS Code or optional GitHub Codespaces under GitHub's own terms.
4. Changes to and discontinuation of services
4.1 We may change the platform where this is reasonable for you, in particular because the change is minor and objectively justified. Objective reasons include technical development, platform security, legal requirements or changed resources for operation.
4.2 We announce material restrictions (e.g. removal of a course you are enrolled in, or of the workspace service) and the discontinuation of the platform at least 30 days in advance by email and on the platform, stating the reasons. During this period you can download your data or request it from us.
4.3 In case of acute danger to the security of the platform, its users or third parties, we may restrict functions immediately. We then inform you as soon as possible of the reason and expected duration.
5. Acceptable use
5.1 The platform is for learning and teaching programming. In particular, the following is not permitted:
a) cryptocurrency mining and other compute-intensive use unrelated to a course; b) attacks on systems, including port and vulnerability scans, denial of service, brute-force attacks, attempts to escape the workspace, access to other people's accounts or data; c) circumventing resource limits, access restrictions or participation limits, e.g. by using multiple accounts or automated sign-ups; d) sending spam, running proxies, VPN or Tor nodes or bots from the workspace, and offering publicly reachable services from the workspace; e) storing, distributing or linking illegal content, e.g. malware for distribution, copyright-infringing material, child sexual abuse material, incitement to hatred or threats; f) harassing, insulting or exposing other people; g) publishing solutions to graded exercises where the course prohibits this, or other people's submissions without their consent.
5.2 Security research on the platform is only permitted with prior agreement via security@computor.at. Please report vulnerabilities to security@computor.at or confidentially via https://github.com/computor-org/feedback/security/advisories/new. We will not take legal action because of the report against anyone who reports a vulnerability in good faith and confidentially, without accessing other people's data or disrupting operations.
5.3 To protect the platform, we monitor workspace resource usage automatically (see Privacy notice). There is no general monitoring of content.
6. Your content
6.1 Code, texts and files you create remain yours. You grant TU Graz only the rights needed to operate the platform: to store, run and automatically test your content, to show it to the teaching staff and tutors of your course, and to show chat messages to the members of the respective channel. This right is free of charge, non-exclusive and ends once the content is deleted; copies in backups are deleted within the period stated in the privacy notice.
6.2 Upload only content for which you hold the necessary rights.
7. Course material and software
7.1 Unless stated otherwise, course texts and exercises are licensed under Creative Commons Attribution 4.0 International (CC BY 4.0), and course code (code examples, tests, templates) under the MIT licence. Third-party material is marked and may be subject to other licences.
7.2 The platform software is open source under the MIT licence (https://github.com/computor-org).
8. Content moderation
8.1 We do not generally review content. We act when we receive indications of illegal content or of breaches of section 5, for example through a report (see Report content) or through automatic resource monitoring.
8.2 Possible measures, graded by severity, are: a notice to you, removing or disabling individual content, stopping a workspace, temporarily suspending the account, termination under section 9. Automated tools flag anomalies; a human decides on measures against you. To protect against acute danger, a workspace may also be stopped automatically.
8.3 When we take a measure, we tell you by email what we did, the facts we relied on, whether it was based on a report or on automated detection, which law or provision of these terms the content breaches, and how you can challenge it (Art. 17 DSA). We omit this only where authorities or the law prohibit it.
8.4 You can appeal any measure within six months to contact@computor.at. Where possible, the appeal is reviewed by a person who was not involved in the original decision. We tell you the outcome with reasons. You may go to court at any time.
8.5 If we become aware of information giving rise to a suspicion of a criminal offence involving a threat to the life or safety of persons, we promptly inform the police or the competent authorities (Art. 18 DSA).
9. Termination and suspension
9.1 You can end the usage contract at any time without giving reasons by requesting deletion of your account by email to privacy@computor.at from the address linked to your account.
9.2 We can terminate the usage contract for objective reasons, e.g. if the platform is discontinued, with 30 days' notice by email. We delete accounts that have not been signed in to for 24 months after announcing it by email at least 30 days in advance; signing in during this period keeps the account.
9.3 In case of serious breaches of section 5 or of the law, or breaches repeated despite a notice, we can temporarily suspend the account or terminate the contract without notice. Sections 8.3 and 8.4 apply accordingly.
10. Liability
10.1 We are liable under the statutory provisions for damage we cause intentionally or through gross negligence.
10.2 We are not liable for damage we cause through slight negligence. This does not apply to personal injury, to damage to items we have taken over for processing, or where liability is mandatory by law, e.g. under the Austrian Product Liability Act or Art. 82 GDPR.
10.3 If you have not kept copies of important work as recommended in section 3.4, this may be taken into account as contributory negligence in the event of data loss (§ 1304 ABGB).
10.4 Statutory warranty rights remain unaffected to the extent that they apply to this free-of-charge contract.
10.5 You are liable under the statutory provisions for damage you cause by culpable breaches of these terms, e.g. attacks on third parties launched from the platform.
11. Changes to these Terms of Use
11.1 We may change these Terms of Use if the platform, the law or the conditions for its operation change. We inform you at least 30 days before the changes take effect, by email and with a notice at sign-in, provide the new version and highlight the changes.
11.2 Changes that do not put you in a worse position (e.g. clarifications, additional services or adjustments required by mandatory law) apply from the announced date.
11.3 Changes that put you in a materially worse position apply only if you expressly agree to them. We will ask for your agreement at your next sign-in. Merely continuing to use the platform is not agreement. Until you agree, the previous version continues to apply to you; we may then terminate the contract under section 9.2.
12. Applicable law and jurisdiction
12.1 Austrian law applies, excluding its conflict-of-law rules. If you are a consumer, you additionally keep the protection of the mandatory provisions of the law of the country where you have your habitual residence (Art. 6(2) Rome I Regulation).
12.2 If you are a consumer, you can sue us in Austria or at your place of residence, and we can sue you only at your place of residence (§ 14 Austrian Consumer Protection Act, KSchG; Art. 18 Regulation (EU) No 1215/2012). For businesses, the court in Graz having subject-matter jurisdiction is competent.
12.3 There is no arbitration agreement and no waiver of collective or representative actions.
